2. The Public Forums shall be used only in a noncommercial manner. You shall not, without the express approval of WatcherswebClubhouse.Com , use the Public Forums to distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services, or to promote Web sites or online services that are competitive with WatcherswebClubhouse.Com and the Service. You agree that you will not submit any ideas for stories, features, designs, scripts, merchandise or publication of any type.

While we do not and cannot review every message posted by users in the Public Forums and are not responsible for the content of any of these messages, WatcherswebClubhouse.Com reserves the right to delete, move or edit messages that we, in our sole discretion, deem are in violation of the law (including trademark and copyright law), or these Terms of Service, or are abusive, defamatory, obscene or otherwise unacceptable. You shall remain solely responsible for the content of your messages.
    
4. By registering your profile with us, you agree to receive promotional material via email from Cactus Beach Pty ltd.
    
5. Images/videos posted in WatcherswebClubhouse.com may be used for promotional purposes.

7. CONTENT PROVIDER AGREEMENT.
    

   In order to upload Content to the Website, you must be registered member of Watchersweb.com AND OR Watchersweb Clubhouse .com   save and except if such Content is limited to comments, a cover picture and/or an avatar. If the information you provide for the creation of your account is not true and correct, you face the immediate termination of your account and you may be subject to legal sanctions.

   You represent and warrant that with respect to all Content you will upload on the Website:

8. the Content does not contravene to any applicable laws and does not subject the Website to any claims, demands, lawsuits, regulatory actions or any actual, potential or risk of liability, or any threats thereof;
9. you own the rights to use the Content on the Website and that the Content does not infringe on the rights (including intellectual property rights) of a third party and, that you have obtained the consent and release for every individual appearing in your Content, including the right for you to use and upload the Content on the Website;
10. for every individual appearing in your Content you have carefully ascertained and examined a valid governmental photo identification demonstrating that they are at least 18 years of age on the day they are photographed, filmed or otherwise appearing in such Content (this applies to all individuals, whether identifiable or not, or whether nude or not);
11. with respect to the Content, you, or the producer of the Content, have collected and maintained the records required under 18 U.S.C. § 2257 et. seq., as modified from time to time in compliance with the rules and regulations set forth in 28 C.F.R. § 75 et. seq., as modified from time to time, and any other applicable records keeping or age verification laws;
12. the Content is not a duplicate of another piece of Content uploaded by you;

Failure to comply with these Terms of Services, or should we determine that any of the statements above is untrue, or not complied with, we may, in our sole discretion, refuse to include the Content or any part thereof or any references to such Content on the Website, remove the Content in question from the Website, terminate your account and take any measures necessary to minimize or eliminate any liability.

    We may, in our sole discretion, terminate your account if you breach any of the Terms of Service or at any time for any reason even without cause.

    If we believe that your Content violates any criminal laws your account will immediately be terminated, you will be banned from the Website without notice and we will report you to law enforcement authorities
     

Risk of Loss

1.         All items purchased from the Site are made pursuant to Product Description. This means that the risk of loss and title for such items passes to you upon payment and access. "Lifetime Membership" means Lifetime of the site.Should any site licensed and or owned by Cactus beach Pty ltd cease to operate Membership shall cease and non refundable.

Chatroom specific rules are posted upon entry to the chat and I will abide by those rules also
I understand if I break any rules in the Clubhouse can be banned Temporarily or permanently and if a premium member I am not entitled to a refund.
All messages older than 90 days will be automatically deleted from mailboxes.
To protect privacy data, all accounts that have not logged in for two years will be deleted. Membership records are deleted from our server and can not be retrieved. Membership payments will not be refunded.
